Legal malpractice occurs when an attorney fails to comply with the standard of care for an attorney in the same or similar circumstances. Examples of legal malpractice include a wide variety of things, including failing to file a lawsuit by the statute of limitations; failing to provide notices necessary for the prosecution of a claim; incorrectly drafting legal documents; failing to properly litigate a case, including failing to obtain necessary evidence and retain necessary experts; settling for too little; and a wide variety of other acts or failures to act.
