About Legal Malpractice/Attorney Negligence

Legal malpractice is generally the same as attorney negligence. Legal malpractice occurs when an attorney fails to comply with the standard of care for an attorney in the same or similar circumstances. Examples of legal malpractice include a wide variety of things, including failing to file a lawsuit by the statute of limitations; failing to provide notices necessary for the prosecution of a claim; incorrectly drafting legal documents; failing to properly litigate a case, including failing to obtain necessary evidence and retain necessary experts; settling for too little; and a wide variety of other acts or failures to act.

While lawyers are often joked about, many do a good job for their clients and perform a useful and necessary role in our society. However, when they make an error it can have serious consequences.
